Dr Gerta Sámelová Flassiková

Gerta is a managing partner at the law firm alianciaadvokátov ak, s.r.o., which was founded in 1991, initially as a consortium, and has operated as a limited liability company since 2006. Previously, she worked at the law firm Flassik&Flassiková&Bacho&Valentová.

She served as head of the legal team on several privatisation projects in the water transport and chemical industries. She was active in the energy sector for several years. Together with her colleagues, she drafted legislation in the energy sector and acted as an adviser to the National Property Fund, the Ministry of Economy, the Regulatory Office for Network Industries, SEPS, as well as during the initial stages of the unbundling of distribution companies. She has worked for numerous local and international clients in the automotive, food and clothing industries. In this context, her work has included, amongst other things, mergers, acquisitions and related legal due diligence

She specialised in property and construction law, providing legal advice to a number of local and foreign property developers. She also provided legal advice on PPP projects – primarily in the construction of motorways and expressways, as well as in the healthcare sector.

Since 2001, she has specialised in aviation law. She acted as chief legal adviser during the establishment of Sky Europe Airlines, handling matters ranging from ensuring compliance with regulatory requirements to resolving issues relating to the airline’s day-to-day operations.

She is involved in the drafting, review and negotiation of aircraft lease agreements, in particular Lease Aircraft Agreements, Lease Novation Agreements, Security Trust Agreements and Security Agreements. She leads the team responsible for protecting the rights and defending the interests of the air carrier in proceedings concerning passenger claims arising from Regulation (EC) No 261/2004 of the European Parliament and of the Council.

She also specialises in franchising, representing both franchisors and franchisees.

Throughout her long-standing legal practice, she has represented clients in court proceedings concerning commercial, civil and employment law.

Her publishing activities focus on writing specialist articles for business periodicals such as *Slovak Spectator* and *Trend*.

She also contributed to the publication *European Current Law* in 2006–2007, published by Sweet & Maxwell.

She is a co-author of the publication *World Intellectual Property Rights and Remedies*, published by Oceania and Oxford University Press.
